Remember Remember the 5th of November;
Gunpowder, treason and plot…
Its bonfire night and for most that means fireworks, sparklers, toffee apples and Guy Fawkes!
Unfortunately for A&E departments across the country Bonfire Night instead depicts a grim night. Statistics show over 1,000 patients are submitted into hospital on 5th November, most of whom are young children.
Why are Bonfire Night Accidents so Common?
A large fire tended by untrained members of the public, sparklers burning at 2,000 Degree Celsius and fireworks whizzing off at speeds of 150mph! With these dangers, the high frequency of firework and bonfire accident claims is hardly surprising.
Burns are the most common injury caused. Often burns are superficial; however, some injuries involve nerve/ muscle damage, blindness and permanent scarring.
Common Causes for Firework Accidents
- Sparklers being handled without the appropriate gloves or eye protection
- Fireworks being set up incorrectly
- Too close proximity of the public to firework displays
- Faulty fireworks or misleading instructions to fireworks
Can I Claim for Firework and Bonfire Night Injuries?
Claim against firework/ bonfire display
The organiser has a legal duty to ensure the safety of its spectators and staff. Should they fail to follow legal requirements or negligently implement firework safety guidelines they are liable for your injury.
Private bonfire display
It can be much more difficult pursing compensation claims relating to private events, though not impossible. Your personal injury solicitor will be able to assess the situation and facts surrounding your injury and explain your options.
Fireworks illegally set off in public place, street or thrown towards you
This kind of incident should be reported to the police, in these circumstances you are still entitled to compensation through a criminal injury claim.
If you have suffered an injury from a firework accident, contact our expert personal injury department. We will assist you in obtaining compensation not only for your injuries, but also financial losses incurred and the costs for any necessary cosmetic surgery.
