What is professional negligence?

How do you prove professional negligence?
- The professional owed you a duty of care;
- The professional breached that duty of care;
- You have suffered a financial loss; and
- Further, that your financial loss is a result of the professional’s breach of duty. If the loss would have occurred in any event, even if the professional had not been negligent, you would not have a successful claim. This is known as causation.
To prove your claim, some of the evidence that our team might collect includes:
- Experts who can provide professional opinions on the matter. For example, statements from people who work in the same industry as the professional.
- Any documents that may serve as evidence. For example, the contract between you and the professional, their file of papers, and copies of communications between you and the professional.
What is an example of a case of professional negligence?
However, an example may be where you are buying a property, and instruct a surveyor to inspect the property before you purchase. If the surveyor fails to spot a serious structural problem with the property, you could pay too much for your property.
