| Buying a property

Understanding the conveyancing process will help you avoid delays and ensure that you know what to expect during the conveyancing transaction. The main steps are set out below, but if you have any questions, please feel free to call us to speak to one of our residential property team.

Arranging a mortgage

One of the first steps to take is to look at your finances and find the right lender. You can apply for a mortgage offer in principle, which will give you an advantage when it is time to make an offer. You can also start putting together all of the paperwork that your lender will need at this stage, so that your full application can be made promptly as soon as you find somewhere to buy.

Instructing a solicitor

Instructing a solicitor early on is also a good way to reduce the time taken in a conveyancing transaction. If you would like us to deal with your property purchase, we will work to verify your identity, open a file and provide you with the initial forms to be filled in. This means that as soon as you have an offer accepted, we can start work.

Arranging a survey

It is always recommended that you have a survey done. The valuation carried out by your lender will not be in-depth and may not reveal issues with the property that you need to know about. Your surveyor will be able to give you advice about the best type of survey to have. If any problems are revealed, you can ask experts to quote for remedying them and then renegotiate the price where necessary to take the cost of the work into account.

Searches and enquiries

Once you have found somewhere to buy, you can pass on our details to the estate agent, and they will give these to the buyer’s solicitor. We will then receive the contract package and be able to start the due diligence work needed.

We will go through the papers and raise enquiries with the seller’s solicitor and apply for a local search and any other necessary searches or reports.

Once we have all the information back, we will check this and let you have our report on the property.

Exchange of contracts

If you are happy to go ahead, you can sign the contract and mortgage deed in readiness for exchange. The contract will not be binding until exchange. You will also need to let us have cleared funds for the deposit, which is generally 10% of the purchase price, although we can usually use the deposit on a related sale, if you have one.

We will discuss completion dates with you and liaise with the rest of the chain. Once everyone is ready, we will exchange contracts and at that point, the completion date will be set.


As soon as contracts have been exchanged, we will carry out the final pre-completion checks and order your mortgage advance. We will let you know how much we need from you in cleared funds to complete.

On the day of completion, we will let you know as soon as we have confirmation that the seller’s solicitors have the money. You will then be able to liaise with the estate agent regarding collecting the keys to your new property.

| Selling a property

If you are selling a property, you can ask us to represent you early on, before you have a buyer, so that we can let you have the property information and fixtures and fittings forms for completion. This will give us the opportunity to send out the contract package promptly as soon as you find a buyer, which can cut the time taken to reach exchange of contracts.

We always work proactively to ensure a transaction keeps moving forwards. We will respond to enquiries as soon as we can and make sure that we keep in close contact with your buyer’s solicitor to check that there are no problems at their end.

We will obtain a redemption statement from your lender and let you have the figures, so that you know how much you will be receiving on completion of the sale. Where necessary, we will tie in a related purchase.

Following completion, we will arrange for your mortgage to be redeemed.

| Remortgaging a property

If you are remortgaging a property, you will need a solicitor to deal with the transaction for you, unless you are staying with your existing lender. We will need to carry out due diligence work so that we can report to the lender in the same way as we would for a purchase.

This includes providing you with a property information form to fill in and either carrying out searches or putting indemnity insurance in place. We will let you have a redemption statement as soon as we receive this so that you can see how much they will need to discharge your mortgage and what penalties or exit fees, if any, they intend to charge.

Following completion, we will arrange for your existing mortgage to be redeemed and your new mortgage to be registered at the Land Registry.

| Equity release

If you are considering equity release, you will need advice from expert equity release solicitors. If you ask us to help you, we will go through the paperwork with you in detail, ensuring that you understand the implications of signing.

The most popular type of equity release product is a lifetime mortgage. This involves the payment of a lump sum to you in return for the lender having a share of your home in the future when it is sold.

There are many terms and conditions involved and we will ensure that these are explained to you and that you are happy to proceed.
