Private and public nuisance

A private nuisance occurs where someone does something lawfully on their own land, but which interferes with their neighbour’s enjoyment of their land. Private nuisance can come from residential or a commercial property. Where that nuisance affects the general public, this is likely to be known as a public nuisance.

There are many examples of nuisance including:

Noise nuisance from a neighbouring kennels;
Oil leaking from a tank, contaminating the neighbour’s soil;
Water flooding from a neighbour’s land;
Tree roots causing damage to a neighbour’s land.

Where that nuisance affects the general public, this is likely to be known as a public nuisance. For example, road obstructions or dust from factories.
