What is professional negligence?
Professional negligence is where a professional fails to perform their responsibilities to the required standard, or breaches a duty of care. The professional’s inadequate conduct then causes their client or customer a financial loss.

How much will it cost?

We generally charge between £1,500 and £2,000 plus VAT to review your case and provide you with our advice.

How do you prove professional negligence?
To be successful in a professional negligence claim, you will need to show that:

  1. The professional owed you a duty of care;
  2. The professional breached that duty of care;
  3. You have suffered a financial loss; and
  4. Further, that your financial loss is a result of the professional’s breach of duty. If the loss would have occurred in any event, even if the professional had not been negligent, you would not have a successful claim. This is known as causation.

To prove your claim, some of the evidence that our team might collect includes:

  • Experts who can provide professional opinions on the matter. For example, statements from people who work in the same industry as the professional.
  • Any documents that may serve as evidence. For example, the contract between you and the professional, their file of papers, and copies of communications between you and the professional.
What is an example of a case of professional negligence?
There are many different types of professional negligence.

However, an example may be where you are buying a property, and instruct a surveyor to inspect the property before you purchase. If the surveyor fails to spot a serious structural problem with the property, you could pay too much for your property.

In such a situation, we could assist you in making a professional negligence claim against the surveyor.

How do I make a professional negligence claim?
The first step towards making a professional negligence claim is to seek expert legal advice. Not least because every professional negligence claim is slightly different. There is no one size fits all process.

The first stage will usually involve a discussion with one of our specialist professional negligence solicitors. They will take information about the negligence and the amount of loss it has caused you.

Following this, your solicitor will start building your professional negligence claim. Including pulling together copies of the professional’s files and other documents relating to the negligence and your contract with the professional. We will then advise you on your prospects of success, the amount of compensation you may be entitled to claim, and the best course of action. We will advise you on the likely costs and timeframes, and update you throughout.

What is the time frame for bringing a professional negligence claim?
To make a professional negligence claim you should act as swiftly as possible. In most professional negligence cases, the time limit to make a claim is six years from the date of the negligence. This is known as limitation.

However, when the negligence has not become evident until later, this time limit may be extended.

The time limits are strict. We therefore recommend that you speak to specialist professional negligence solicitors as soon as you become aware that the professional may have been negligent.
