There sometimes comes a stage in a landlord / tenant relationship, where the landlord requires the property back. A landlord will usually want to repossess a property for one of two reasons. Firstly, that there has been a change in the landlord’s circumstances. For example, you require the property to live in yourself. Or secondly, a landlord may seek to evict their tenant because relations with them have broken down. This could be because the tenant has failed to pay rent, has caused the property to fall into disrepair or has breached other terms of the tenancy agreement, for example.

Residential possession proceedings

The procedure for seeking possession of a property from a tenant is technical and usually requires a court order. Specific notices must be served, and timescales observed. If you do not follow the correct procedure, the Court may not allow you to repossess your property.
