What a successful year it was for our professional negligence team! Building on its previous successes, the team successfully recovered over £800,000 in compensation for its clients during 2017.

Below are some examples of professional negligence claims against solicitors that we settled during 2017:
1. Property solicitors
Our client (a property investment company) instructed solicitors to draw up a sub-lease some years ago. Directors of the tenant company were to be sureties to the lease. It later became apparent that when the lease was drawn up, no sureties were included. When the tenant fell into financial issues, our client was left with an empty property and substantial rent arrears, unable to claim these from any sureties. We successfully negotiated an amicable settlement, avoiding court proceedings.
Level of settlement: £80,000 + costs
2. Dispute resolution solicitors
Mr & Mrs H instructed the team to consider a claim against a firm of solicitors for failing to adequately advise on their prospects of success in bringing a nuisance claim against their neighbours. The professional negligence team instructed experts to value the claim. Once we had this figure, we were able to agree a very favourable settlement in November 2017.
Level of settlement: £77,500
3. Company and commercial solicitors
The dispute resolution team acted for Mrs C in a company dispute. We issued a claim, and later settled just before the trial. After the claim was settled, Mrs C intimated a professional negligence claim against the firm of solicitors for failing to ensure that her interest was protected within the consultancy agreement (which consultancy agreement had been the reason behind the company dispute in the first place). We successfully secured a good result through the mediation in March 2017.

4. Dispute resolution solicitors
Mr S had previously instructed solicitors to deal with a dispute between him and his tenant. Finding that the solicitors had not properly advised him, he instructed the team to bring a claim against the former solicitors for negligence. The team advised the client and negotiated a settlement with the negligent solicitors.
Level of settlement: £7,000
5. Personal injury solicitors
We acted for a client in a claim against a firm of solicitors for their earlier failures in dealing with a personal injury claim. The matter was complicated, and the team instructed various experts to carry out complex valuations. We were delighted to finally reach a settlement in November 2017.
Level of settlement: £175,000 plus costs
6. Wills and trusts solicitors
We represented Mr W in a claim brought against his former solicitors as a result of their failure to properly advise on a trust fund. We were successful in securing an excellent settlement for our client in December 2017, recovering our client’s legal costs.
