| Buying property

If you are buying a property, we can represent you in the transaction, checking that the legal title is sound, liaising with your mortgage lender and, where necessary, tying in a related purchase.

The main stages in a property purchase are as follows:

Arranging a mortgage

The first step is to select a mortgage lender and request a mortgage offer in principle. This will give you the chance to find out how much you are likely to be able to borrow and will also show sellers and estate agents that you are a serious buyer who is ready to proceed.

You will also be able to check with the lender what financial paperwork they will need from you with your full application in due course, once you have found a property to buy.

Finding a conveyancer

You can ask a conveyancing solicitor to represent you early on before you have had an offer accepted. If you ask us to deal with your purchase, we will let you have the preliminary forms for completion, check your identity as required by law and open a file so that we are ready to go ahead as soon as you have a deal in place.

Having a survey carried out

Once you have found the right property, a survey is generally recommended. You can choose a level of detail appropriate to the property you are buying. For example, a modern home in good condition and of conventional design and construction may only need a homebuyer report. If any issues are discovered by the surveyor, you can try to negotiate an allowance from the seller to cover the cost of any work needed.

Conveyancer makes searches and raises pre-contract enquiries

The seller’s solicitors will send us a substantial package of documents along with the draft contract. This will include a copy of the legal title, a copy of the official plan of the property, property information forms, a fixtures and fittings list and copies of any documents referred to in the title or information forms.

We will go through these in detail and return to the seller’s solicitor with a list of questions. We will also apply for searches at this stage, to include a local search and drainage search.

Once we have all responses along with your formal mortgage offer, we will report to you on the property and check that you are happy with the terms and conditions of the mortgage.

You can then sign the contract in readiness for exchange. You will also need to let us have a deposit to be paid to the seller’s solicitor on exchange. This is usually 10% of the purchase price. If you have a related sale, we can use the deposit from this.

Exchange and completion

We will discuss completion dates with you and the rest of the chain. Once a date is agreed upon and everyone is ready to proceed, contracts can be exchanged. This is when the transaction becomes legally binding and the date for completion is set.

We will let you know how much we need from you to complete your purchase and order your mortgage advance. On the day of completion, we will ring you as soon as the seller’s solicitor confirms receipt of the balance of purchase monies and you can contact the estate agent to arrange to pick up the keys to your new home.

| Selling property

When you sell a property, you will probably want to reach the point of exchange as quickly as possible, particularly if you are tying in a purchase. We always stay in close touch with buyers’ solicitors to move matters forward effectively, ensuring that they have the information they need without delay.

You can ask us to act for you as soon as you decide to market your property and we will carry out some of the preliminary work straightaway, such as opening a file and verifying your identity, so that we are ready to issue the contract papers once you accept an offer.

You will need to fill in a property information form, and we can also let you have this early on so that you have plenty of time to complete it and find any documents needed to accompany it, such as planning consents and guarantees.

| Transferring property

If you are thinking of transferring a property into joint names with someone else or from joint names into a sole name, you should take legal advice before completing the transfer.

It is important to make sure that your interest in the property is protected. We can advise you of your options and go through the two main types of joint ownership with you, providing you with the guidance you need and establishing which will be best for your circumstances.

| Remortgaging property

When you remortgage, you will usually need a solicitor to represent you in the transaction and to carry out due diligence work on behalf of your new lender.

We are authorised to represent all of the main high street lenders, meaning we can work for both them and you in the transaction.

We always aim to complete a remortgage as soon as possible, as we know that it is usually beneficial to move to a new deal. We will make sure that you have a clear and up-to-date statement showing the amount your existing lender will need to redeem their charge, which could include administration fees and exit charges, so that you know how much will be payable to you on completion or how much we will need from you to complete.

| Equity release

Equity release policies are onerous, and the law requires that you take independent legal advice before signing them. We can go through the terms and conditions with you and make sure that you fully understand the implications.

You may have the opportunity to pay off the interest each month on the capital that will be advanced to you and we will make sure you are aware of the choices and the benefits or drawbacks of the available options.
