Adverse possession

Adverse possession is where someone occupies a piece of land or a property belonging to someone else without permission. It is essentially squatting. If the person occupies the land in a certain way for a certain number of years (10 or 12, depending on the circumstances), it is possible for them to apply for the land to become theirs.

Adverse possession claims can be complex and require historic information and evidence. We can assist in collating the information to make your claim, or indeed to defend a claim made against a piece of your land.

If you have an empty residential property, there is a risk that a trespasser or “squatter” might enter and move in. Unfortunately for property owners, you must obtain a possession order before you can evict the trespasser. This is what they refer to as “squatters’ rights”.

We will deal with a claim for possession against trespassers urgently to ensure that you recover your property safely and quickly.

Errors and misrepresentations when you purchased the property

Sometimes errors made by the people who sold you the property raise their heads after you have moved in. If your seller told you as part of your purchase process that you were purchasing something that you weren’t, you may have a claim for misrepresentation against your seller.
