Who Pays For Care Home Fees?
Care home funding is quite complicated and when somebody moves into care there can be many different parties involved. Also, people have very different experiences depending on where they live.
Incorrect decisions are often made and if they go unnoticed or unchallenged, they could prove very costly. It is vital that you understand the system from the outset and are kept fully informed about what is going on. Having some expert advice or assistance can prove to be invaluable.
- NHS Continuing Healthcare
In some cases, the NHS may have a duty to pay for the costs of care. This is known as NHS Continuing Healthcare (CHC). Whether or not a person is eligible for CHC will depend upon their individual care needs. This is not means-tested, so the individual’s financial position is not relevant.
- NHS-funded nursing care
If an individual is not eligible for CHC, they may still be eligible for NHS Funded Nursing Care. This is a fixed amount paid directly to a nursing home to pay for registered nurses employed by the home.
- Local authority
If the person going into care does not qualify for CHC, the local authority may have a duty to pay some or all of the costs. This will be based on the individual’s financial position and is subject to a means test.
How Can We Help You Plan For Your Care Home Fees?
On average, individuals stay in care homes for 4.3 years. This could leave you and your estate with a bill of £175,000 or more. It is important, therefore, that you plan for how you will manage these costs.
At Levi Solicitors we can provide specialist advice on planning for your care home fees. This advice will be tailored to your needs and could include, for example:
- Ensuring that your will (and that of your spouse or partner) is structured in the best way to protect your loved ones’ inheritance.
- Advice on whether you may be eligible for CHC or other funding.
- Challenging decisions on care home funding
For years there have been many unregulated firms who have advised people to make gifts of their properties into trusts in order to avoid paying care fees. They often provided poor advice and didn’t make their clients aware of the potential risk involved. If you have carried out some planning of this nature and you are unsure about the advice you received, let us know and we would be happy to look into it for you.
