What Is Contentious Probate?
Contentious probate refers to a dispute in relation to the administration of an estate. It can involve (amongst other things): disputes over the value of assets, invalid wills, inaction by executors, how a will is interpreted or beneficiaries who feel hard done by (inheritance disputes).
How can I challenge a will?
There are different ways to challenge whether a will is valid. These include:
- The person making the will lacked the mental capacity to make the will
- Someone pressured the deceased into making the will
- The will was not signed and / or witnessed properly
- The will is a forgery.
What can I do if I have concerns about an executor?
The executors of the estate will be responsible for collecting in the assets and distributing them to the beneficiaries. Sadly, there are sometimes breakdowns in the relationship between the executors and the beneficiaries. For example, if the beneficiaries do not believe that the executors are acting in the best interests of the estate and the beneficiaries.
If there has been a breakdown in the relationship, seek legal advice as soon as possible. We can advise you on the best way forward. And, if necessary, apply to the court to remove the executor(s) and appoint a replacement.
