Over the past few months, Gemma Horner and our professional negligence team have achieved some fantastic results for our clients in claims against solicitors.

Professional negligence claim against probate solicitors

We acted in a claim against the clients’ former probate solicitors.

The solicitors had been instructed in relation to the administration of our clients’ late father’s estate. However, they delayed in submitting the application for the grant of probate, leading to the clients eventually doing this themselves.

Due to the delays, the value of the estate reduced.

We submitted a letter of claim, and after a period of negotiation, settled the claim. The clients were pleased with the damages achieved, which compensated them for their various losses, including costs.

Claim against litigation solicitors

Our client had instructed litigation solicitors to deal with a dispute regarding the ownership of a residential property.

As a result of repeated errors and failures by the solicitors in the original proceedings, judgment was entered against our client along with an order for costs.

We were instructed in a claim against the solicitors, who initially denied liability. However, we eventually settled the claim for a sum that the client was happy with, without the need to resort to court proceedings.

Claim against conveyancing solicitors

Our clients purchased a property, intending to use it as their home and for their business. Following the purchase of the property, our clients built on their new land. The new structure was to be used for their business during office hours, and for the clients’ children in the evening and weekends.

Shortly after, our clients received notification from the local authority that the property was in green belt land and they needed planning permission. Our clients’ applications for retrospective planning permission were unsuccessful.

Our clients’ conveyancing solicitors had obtained local authority search results that confirmed that the property was in the green belt. This information was not passed to the clients prior to completion.

The professional negligence claim included a claim for loss of earnings and wasted costs related to the purchase of the property. We successfully recovered significant compensation and costs for our client.

Claim against property litigation solicitors

Our client had instructed the solicitors to act in a claim for relief from forfeiture of their commercial property. The solicitors missed the deadline to issue proceedings against the landlord, and the landlord subsequently sold the lease to a third party. As a result, our client lost their investment property.
