With the Government asking pubs, clubs, restaurants and cafes to close last Friday, owners of bars, restaurants, pubs and clubs are looking at other ways to keep cashflow moving. A number of routinely on-sales premises are moving to offering off-sales and delivery of food.  We are seeing various operators considering whether they are able, without additional provision, to do so including the delivery of alcohol. Premises licences and takeaways

There is no requirement for a premises licence to sell hot food and drinks whether to eat in or takeaway. However, you will require one if you intend to sell and supply it between 11pm and 5am.  Your premises licence may already allow for late night refreshments. It is best to check that you are able to do so before going ahead, however.  If you are seeking to sell hot food and drinks prior to 11pm you will require a premises licence for this.

Do I need a premises licence to deliver alcohol with takeaway food?

If you are looking to deliver alcohol, you will need to look at your premises licence. Where the licence includes off sales and does not have any conditions preventing either off sales or home delivery, you should be ok to go ahead and add alcohol to your takeaway offering. You will still need to comply with all of your relevant conditions including age verification policies etc.
